ADA: Work & Public Accessibility Claims

Helping Gain Access for People With Disabilities

There are specific laws in place to protect people with disabilities. At the San Jose law firm of Williams, Pinelli & Cullen, LLP, our attorneys help clients understand and protect these civil rights. We handle state and federal claims involving ADA compliance in the public sector, as well as in the workplace.

If you believe you may have an ADA claim or have questions about your rights under the law, contact us to schedule a consultation with an experienced San Jose attorney.

If you have a disability and have been denied complete access to your workplace or a public place because of your disability, the Americans with Disabilities Act (ADA), also known as the Americans with Disabilities Law, may give you a legal remedy. In addition, if your situation is not specifically covered under the ADA, California has established broader laws that may provide a remedy for your situation.

ADA and Employment Claims

The ADA, adopted nearly two decades ago, has helped people with disabilities gain much-needed access to many previously inaccessible workplaces. Unfortunately, here in California, there are still many facilities that do not provide adequate access.

If you have found yourself unable to perform your job duties because of a lack of appropriately located parking spaces, accessible bathrooms, ramps or other accommodations, we can help you determine whether the ADA has been violated, and if so, we can counsel you about advisable strategies for seeking a remedy.

In addition, if your claim is not covered under the ADA, we can examine whether legal protection is available via California's Fair Employment and Housing Act (FEHA). In general, more people are covered under the FEHA than under the ADA. For example, people with a temporary disability may not be protected by the ADA, but would be protected by FEHA.

If you choose to take an Americans with Disabilities Act case to court, you will have the extensive trial law experience of Williams, Pinelli & Cullen, LLP behind you.

Disability Discrimination

Please note, if you believe that you have been discriminated against because of your disability, you may also have an employment law claim against your employer. Learn more about harassment, discrimination and retaliation.

ADA and Public Access: A Law to Ensure Access for All

The Americans with Disabilities Act, in part, puts into law the goal of access to workplaces and public buildings for people with disabilities. To further that goal, newly built facilities or facilities to which major improvements are made must be brought into compliance with specific ADA access requirements.

Not only can the owner of a building be held responsible for handicap access law violations; a tenant who operates a facility within the building is also liable.

The Americans with Disabilities Act is a complicated law. Our lawyers can help you understand whether your specific concern can be addressed with the help of the ADA. If your case is not covered under the ADA, we can examine the situation to determine if protection is available under California's Unruh Civil Rights Act. This law prohibits discrimination against people with disabilities in all businesses, including public places and housing.
