Automobile Accident

Our client was severely injured in an expressway accident case when a car side-swiped her vehicle and pushed her off the road and into a tree.  The other driver only had a $15,000 liability policy.  After personally visiting the site and calculating that the tree was too close to the roadway pursuant to Governmental Guidelines, we were ultimately able to recover approximately $600,000 from various sources including the owner of the tree.

Motorcycle accident

Our client was injured when a driver of a car exited a private driveway and cut our client off causing severe injuries.  The driver of the car only had a $15,000 automobile liability insurance policy.  We were able to recover $315,000 total, including $300,000 from the property owner under a theory we developed after visiting the accident site and determining that bushes may have blocked the car driver’s view. 

Boat/auto accident

After a day on a boat on the on the Delta, our client lost three fingers from his right hand when he was assisting the boat owner with the loading of the boat onto a trailer.  As the boat was being pulled out of the water by the owner’s automobile, the rope attached to the boat was being used by our client trying to position the floating boat on the trailer.  The rope was too long and was looped such that when the car tried to pull the boat and trailer forward it got caught on a cleat on the dock, tightened as the car continued to try to move forward and severed our client’s three fingers. 

The insurance carrier said that only the automobile policy applied and offered the $100,000 limits from the car’s policy.  They refused to pay the additional $400,000 that was available under the boat’s insurance policy, saying there was no insurance coverage that applied.  They claimed the boat was being towed and that was excluded under the boat insurance policy.  After creative and intensive work, we ultimately got the insurance carrier to pay much more than the $500,000 available insurance limits available, and received a total of $1.1 million.

Product falling from display

In a recent jury trial the jury awarded our client $120,000 - - twice what had been offered prior to trial - - against a well known discount store when a toilet seat fell from a display and landed on our client’s arm injuring his bicep.  We were able to prove negligence on the part of the defendant, over the defendant’s vehement objections, that perhaps another customer has caused the problem.
